1. INTRODUCTION

Welcome to Merojob.com, hereinafter referred to as "we", "us", or "Merojob". We are an online career platform, and these terms and conditions govern your access to and use of Merojob, including its related subdomains, websites, mobile applications, services, and tools (collectively referred to as the "Site"). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions (the "User Agreement"). This User Agreement becomes effective upon your use of the Site and signifies your acceptance of its terms. If you do not agree with any of these terms, please do not access, register with, or use the Site.

The Site is owned and operated by Merojob Ltd. We reserve the right to change, modify, add, or remove portions of these Terms and Conditions at any time without prior notice. Your continued use of the Site following any changes will constitute your acceptance of those changes.

Merojob.com is designed to serve as a trusted site for facilitating initial contact and the exchange of information between job seekers, employers, and career service providers. It is intended exclusively for individuals and organizations with a genuine interest in exploring or offering real employment opportunities and career development services. Users are expected to engage with the site in good faith for professional purposes related to job placement, recruitment, and career advancement.

2. THE SERVICES

2.1.

By means of the Site, merojob makes available an on-line recruitment and employment information service, where recruiters place advertisements for positions which they have and if interested you as a jobseekers may submit responses to such positions (the "Services").

2.2.

Please note that when responding to recruiters you will be dealing with them directly and as such any contracts and/or arrangements will be formed between you and them, without merojob as a party and merojob cannot be held liable for your use of or any liability arising out of the same (save to the extent required by law).

2.3.

The Services are only available on the completion of the registration section of the Website including confirmation that the relevant terms and conditions have been read and accepted.

3. CONDITION OF USE

A.

Your Account

To access certain services offered by the platform, we may require that you create an account with us or provide personal information to complete the creation of an account. We may at any time in our sole and absolute discretion, invalidate the username and/or password without giving any reason or prior notice and shall not be liable or responsible for any losses suffered by, caused by, arising out of, in connection with or by reason of such request or invalidation.

You are responsible for maintaining the confidentiality of your user identification, password, account details, and related private information. You agree to ensure your account remains secure, take all necessary steps to prevent misuse, and notify MeroJob immediately if you suspect unauthorized access or use of your password. Any activity conducted through your account, whether authorized by you or not, is deemed performed or authorized by you. You agree to be bound by such activities and indemnify MeroJob against any losses arising from the use of or access to the platform through your account.

Ensure that the details you provide us with are correct and complete at all times. You are obligated to update details about your account in real time by accessing your account online. For pieces of information you are not able to update by accessing Your Account on the Site, you must inform us via our customer service communication channels to assist you with these changes. We reserve the right to refuse access to the Site, terminate accounts, remove or edit content at any time without prior notice to you. We may at any time in our sole and absolute discretion, request that you update your Personal Data or forthwith invalidate the account or related details without giving any reason or prior notice and shall not be liable or responsible for any losses suffered by or caused by you or arising out of or in connection with or by reason of such request or invalidation. You hereby agree to change your password from time to time and to keep your account secure and also shall be responsible for the confidentiality of your account and liable for any disclosure or use (whether such use is authorised or not) of the username and/or password.

Privacy Policy

Please review our Privacy Policy, which also governs your visit to the Site. The personal information / data provided to us by you or your use of the Site will be treated as strictly confidential, in accordance with the Privacy Agreement and applicable laws and regulations. If you object to your information being transferred or used in the manner specified in the Privacy Agreement, please do not use the Site.

Your personal data will be collected and processed by merojob in accordance with its privacy policy. The personal data collected may include, without limitation, your name, address, telephone and fax details, email contact address, and other data obtained from you from time to time.

Information may be gathered from your registration form(s) and your use of the Sites and/or the Interactive Services including through "cookies". Cookies are blocks of text placed in files on your computer's hard drive when you visit a web site which contain information to identify you. A cookie does not contain any personal information you have provided us with, except your user's name, unless the cookie attached to personal information collected another way, such as by means of your on-line registration form.

The information gathered may be used by Merojob Limited and companies in the same group as Merojob Limited (ie companies which share the same ultimate parent company) internally, for purposes relating to your use of the Sites and the Interactive Services and for marketing activities, and may be passed to carefully selected third parties to use for marketing activities. By marketing activities, we mean the communication directly to particular individuals (by e-mail, post or telephone) of any advertising or marketing material. If you do not wish to receive marketing material from Merojob, from companies in the same group as Merojob Limited or from carefully selected third parties you should tick the appropriate box on the registration form(s) or notify us by e-mail. If you subsequently decide you no longer wish to receive direct marketing/information from Merojob Limited or companies in the same group as Merojob Limited or no longer wish us to pass your information to third parties you should again notify us by e-mail.

Other than as set out elsewhere, your information shall not be disclosed or used by us. You hereby agree to these terms by your agreement to the terms and conditions of this Agreement.

C.

Platform

You agree, understand and acknowledge that site is an online platform that enables job seekers to apply for jobs and employers/recruiters to post job listings. You acknowledge that MeroJob is a facilitator and not a party to any transactions or agreements between job seekers and employers/recruiters. Contracts formed through the platform are strictly between you and the respective employer/recruiter or job seeker.

D.

Continued availability of the site

We will do our utmost to ensure that access to the Site is consistently available and is uninterrupted and error-free. However, due to the nature of the Internet and the nature of the Site, this cannot be guaranteed. Additionally, your access to the Site may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction. All liability of Merojob, its directors or employees howsoever arising for any loss whatsoever arising from your use of or inability to use the site and/or the services is excluded, insofar as it is possible to do so in law.

E.

License to use the Site

By accessing Merojob.com and its side, you are granted a limited, non-exclusive, non-transferable, and revocable license to use the platform strictly in accordance with the Terms and Conditions outlined herein. This license is provided for the sole purpose of facilitating legitimate career-related activities such as:

  • Searching and applying for job opportunities.
  • Posting job vacancies (for recruiters/employers).
  • Accessing career resources, services, and training content.
  • Participating in Merojob hosted events, webinars or services.
  • Accessing the platform for informational purpose.

By using Merojob.com and its site, you confirm that you are at least 18 years of age, or are accessing the site under the supervision of a parent or legal guardian. You also confirm that you are legally capable of entering into binding contracts under Nepali law.

If you are registering as a recruiter or business entity, you affirm that you have the authority to bind your organization to this User Agreement, and that both you and your organization will comply with applicable laws relating to employment practices, data privacy, and online conduct.

This license allows you to:

  • View and browse the website for personal career or recruitment use.
  • Apply for jobs, or manage your job postings.
  • Use available site tools, such as blogs, or training resources, as intended.

However, this license does not allow:

  • Any commercial exploitation of the website content (e.g., selling access to job listings or copying data for third-party platforms).
  • Data scraping, automated bots, or other tools for collecting or mining personal or professional data.
  • Framing or reusing Merojob's layout, logos, brand elements, or user-generated content without written permission.
  • Modifying, distributing, copying, or reverse-engineering any portion of the site or its software.
  • Registering multiple accounts for fraudulent or manipulative purposes.

All content on Merojob including logos, page layouts, text, graphics, software, and job listings are the intellectual property of Merojob Ltd. or its licensed partners and are protected under copyright and trademark laws. You may not reproduce or use this content for any purpose outside the scope of your granted license. Any misuse of the website, including violation of these license terms, will result in immediate revocation of your access, and may also result in legal action if your behavior causes damage to Merojob or its users.

You are specifically prohibited from:

  • Using the platform to impersonate other individuals or companies.
  • Posting misleading, false, or offensive content or job vacancies.
  • Hosting unauthorized job listings or solicitations unrelated to employment.
  • Using the site in ways that violate national law or the rights of others.

Your Conduct

You must not use the website in any way that causes, or is likely to cause, the Site or access to it to be interrupted, damaged or impaired in any way. You must not engage in activities that could harm or potentially harm the Site, its employees, officers, representatives, stakeholders or any other party directly or indirectly associated with the Site or access to it to be interrupted, damaged or impaired in any way. You understand that you, and not us, are responsible for all electronic communications and content sent from your computer to us and you must use the Site for lawful purposes only. You are strictly prohibited from using the Site for;

  • Fraudulent purposes, or in connection with a criminal offense or other unlawful activity to send, use or reuse any material that does not belong to you; or is illegal, offensive (including but not limited to material that is sexually explicit content or which promotes racism, bigotry, hatred or physical harm), deceptive, misleading, abusive, indecent, harassing, blasphemous, defamatory, libelous, obscene, pornographic, pedophilic or menacing; ethnically objectionable, disparaging or in breach of copyright, trademark, confidentiality, privacy or any other proprietary information or right; or is otherwise injurious to third parties; or relates to or promotes money laundering or gambling; or is harmful to minors in any way; or impersonates another person; or threatens the unity, integrity, security or sovereignty of Nepal or friendly relations with foreign States; or objectionable or otherwise unlawful in any manner whatsoever; or which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any "spam".
  • To cause annoyance, inconvenience or needless anxiety.
  • Any other purposes that is other than what is intended by us.

G.

User Submissions

Any content you submit—such as resumes, job posts, feedback, or suggestions—becomes the property of Merojob. We reserve the right to use, reproduce, or modify it for platform improvement or promotional purposes, unless explicitly stated otherwise. Misleading or impersonated content is strictly prohibited.

H.

Objectionable Content

Merojob hosts job listings, employer profiles, jobseeker profiles, career resources, and user generated content such as reviews, comments, testimonials and blogs. While we strive to maintain a professional and respectful environment, we do not prescreen all content published on the platform. Merojob strives to maintain a professional, respectful, and legally compliant environment for all users. However, given the nature of user generated content such as job listings, employer profiles, jobseeker profiles, reviews, and comments, we may not always be able to monitor every submission or posting. As such, we operate on a "report, review, and remove" basis for content that may be deemed inappropriate, unlawful, or offensive. If you come across any material on the platform that you believe violates legal or ethical standards such as content that is sexually explicit, harassing, defamatory, misleading, discriminatory, racially or religiously offensive, harmful to minors, impersonates someone else, promotes violence, criminal activity, gambling, or threatens the unity and sovereignty of Nepal, you are encouraged to report it to us immediately.

To submit a complaint, please email us at [email protected] with your full name, contact information, a description of the objectionable content (including the URL or location on the site), your reasons for the objection, and any supporting evidence you can provide. All reports are treated seriously, and where appropriate, Merojob will take action to investigate and remove the content in question within a reasonable time frame.

Please ensure that your submission is accurate and complete, as false or baseless complaints may result in delays or rejection of the report. Merojob also reserves the right to take appropriate measures against users who misuse this process, including legal action if necessary.

I.

Claims against objectionable content

We respect the intellectual property of others. If you believe that your intellectual property rights have been used in a way that gives rise to concerns of infringement, please write to us at [email protected] and we will make all reasonable efforts to address your concern within a reasonable amount of time. Please ensure to provide your name, address, contact information and as many relevant details of the claim including name of infringing party, instances of infringement, proof of infringement amongst other. Please note that providing incomplete details will render your claim invalid and unusable for legal purposes. In addition, providing false or misleading information may be considered a legal offense and may be followed by legal proceedings. While we cannot provide legal advice, nor share private information as protected by the law, we recommend that any questions or concerns regarding your rights may be routed to a legal specialist.

Intellectual Property

Merojob.com, Merojob logo, and other marks indicated on our Site are trademarks or registered trademarks in the relevant jurisdiction(s). Our graphics, logos, page headers, button icons, scripts and service names are the trademarks or trade dress and may not be used in connection with any product or service that does not belong to us or in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits us. All other trademarks or logo that appear on this Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us. All intellectual property rights, whether registered or unregistered, in the Site, information content on the Site and all the website design, including, but not limited to text, graphics, software, photos, video, music, sound, and their selection and arrangement, and all software compilations, underlying source code and software shall remain our property. The entire contents of the Site also are protected by copyright as a collective work under Nepali copyright laws and international conventions. All rights are reserved.

Right to Use Employer Logos

By creating an employer account, submitting job postings, or otherwise engaging with Merojob's recruitment services, the employer grants Merojob Ltd. a non-exclusive, royalty-free, worldwide license to use the company's name, logo, and associated branding assets for the purpose of identifying the employer on Merojob.com and in related marketing and promotional materials. This includes, but is not limited to, display on the website, mobile applications, email campaigns, social media posts, sales presentations, and print collateral.

This usage is intended solely to promote the employer's job openings, highlight employer partnerships, or demonstrate platform reach and credibility. Merojob will use the logo in accordance with the employer's brand guidelines (if provided), and will not modify or misrepresent the logo in any way.

If at any time the employer wishes to revoke this permission, a written request must be submitted to [email protected], after which Merojob will make reasonable efforts to cease further use within a commercially reasonable timeframe.

K.

Disclaimer

You acknowledge and undertake that you are accessing the services on the Site and transacting at your own risk and are using your best and prudent judgment before entering into any agreements/arrangements through the Site. We shall neither be liable nor responsible for any actions or inactions of employers/jobseekers nor any breach of conditions or representations by the employers and hereby expressly disclaim and any all responsibility and liability in that regard. We shall not mediate or resolve any dispute or disagreement between you and the employers/jobseekers.

We further expressly disclaim any warranties or representations (express or implied) in respect of quality, suitability, accuracy, reliability, completeness, timeliness, performance, safety, merchantability, fitness for a particular purpose, or legality of the jobs listed or displayed or transacted or the content (including product or pricing information and/or specifications) on the Site. While we have taken precautions to avoid inaccuracies in content, this Site, all content, information, services and related graphics are provided as is, without warranty of any kind. At no time shall any right, title or interest in the jobs displayed on the Site vest with us nor shall Merojob have any obligations or liabilities in respect of any transactions on the Site.

You use MeroJob at your own risk, exercising prudent judgment. MeroJob is not liable for employer actions, job listing accuracy, or breaches of representations by employers. MeroJob does not endorse or support any job listings or transactions and has no obligations regarding agreements formed through the platform. We shall neither be liable or responsible for any actions or inactions of any other service provider as listed on our Site.

L.

Indemnity

You shall indemnify MeroJob, its affiliates, and representatives against claims, demands, or penalties arising from your breach of these Terms and Conditions, violation of laws, or infringement of third-party rights. You release MeroJob from liability for employer actions or inactions.

M.

Third Party Business

Third parties may offer services or post jobs or feature services from external vendors. MeroJob is not responsible for their actions, content, or offerings. Review their terms and privacy policies carefully before engaging with them.

N.

Communicating with us

By using the site or contacting us, you consent to receive communications via email, phone, or SMS regarding your account, opportunities, or platform updates, treating all modes equally for contractual purposes.

O.

Limitation of Liability 

We will not be responsible for any business or personal losses (including but not limited to loss of profits, revenue, contracts, anticipated savings, data, goodwill, or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the Site.

P.

Modifications 

We reserve the right to make changes to the Site, its policies, these terms and conditions and any other publicly displayed condition or service promise at any time. You will be subject to the policies and terms and conditions in force at the time you used the Site unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to jobs and jobs applied or services availed previously you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Q.

Force Majeure

Neither party shall be liable to the other, for any loss or damage which may be suffered by the other party due to any cause beyond the first party's reasonable control including without limitation any power failure.

R.

Waiver

You acknowledge and recognize that we are a private commercial enterprise and reserve the right to conduct business to achieve our objectives in a manner we deem fit. You also acknowledge that if you breach the conditions stated on our Site and we take no action, we are still entitled to use our rights and remedies in any other situation where you breach these conditions.

S.

Termination

In addition to any other legal or equitable remedies, we may, without prior notice to you, immediately terminate the Terms and Conditions or revoke any or all of your rights granted under the Terms and Conditions. Upon any termination of this Agreement, you shall immediately cease all access to and use of the Site and we shall, in addition to any other legal or equitable remedies, immediately revoke all password(s) and account identification issued to you and deny your access to and use of this Site in whole or in part. Any termination of this agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination. You furthermore agree that the Site shall not be liable to you or to any other person as a result of any such suspension or termination. If you are dissatisfied with the Site or with any terms, conditions, rules, policies, guidelines, or practices in operating the Site, your sole and exclusive remedy is to discontinue using the Site.

Governing law and juridiction

These terms and conditions are governed by and construed in accordance with the laws of the Federal Democratic Republic of Nepal. You agree, as we do, to submit to the exclusive jurisdiction of the courts in Kathmandu.

U.

Our Software

Our software includes any software (including any updates or upgrades to the software and any related documentation) that we make available to you from time to time for your use in connection with the Site (the "Software"). You may use the software solely for purposes of enabling you to use and enjoy our services as permitted by the Terms and Conditions and any related applicable terms as available on the Site. You may not incorporate any portion of the Software into your own programs or compile any portion of it in combination with your own programs, transfer it for use with another service, or sell, rent, lease, lend, loan, distribute or sub-license the Software or otherwise assign any rights to the Software in whole or in part. You may not use the Software for any illegal purpose. We may cease providing you service and we may terminate your right to use the Software at any time. Your rights to use the Software will automatically terminate without notice from us if you fail to comply with any of the Terms and Conditions listed here or across the Site. Additional third-party terms contained within the Site or distributed as such that are specifically identified in related documentation may apply and will govern the use of such software in the event of a conflict with these Terms and Conditions. All software used in any of our services is our property and/or our affiliates or its software suppliers and protected by the laws of Nepal including but not limited to any other applicable copyright laws.

When you use the Site, you may also be using the services of one or more third parties, such as a wireless carrier or a mobile platform provider or payment gateway. Your use of these third-party services may be subject to separate policies, terms of use, and fees of these third parties.

You may not, and you will not encourage, assist or authorize any other person to copy, modify, reverse engineer, decompile or disassemble, or otherwise tamper with our software whether in whole or in part, or create any derivative works from or of the Software.

In order to keep the Software up-to-date, we may offer automatic or manual updates at any time and without notice to you.

V.

Assignment

This Agreement shall be personal and binding to you and you may not assign, transfer, sublet, lease or delegate all or any of your rights and obligations, without merojob's prior written consent.

Merojob reserves the right to assign or transfer all or any of its rights and obligations under this Agreement to any companies in the same group or any other third party. In the event of assignment or transfer, notification will either be given to you by e-mail or posted on the Website.

W.

Severablity

If any provision of this Agreement or part thereof is determined to be invalid, unlawful or unenforceable, such provision, or part thereof, shall be severed from the remaining terms, conditions and provisions which shall continue to be valid and enforceable to the fullest extent permitted by law.
